During your Initial Consultation you will learn all aspects of your case. Legal Separation is similar to Divorce. You file the same Petition as for a Dissolution in Family Court. Only you check the box for "Legal Separation" instead of "Dissolution". You still go through the processes of:
*Custody & Visitation
*Child Support
*Spousal Support
*Property Division & Characterization
And any other procedures that may apply such as:
*Paternity
*Domestic Violence
*Restraining Orders
*Child Abduction/Removal of Child
So then the question is:
Why would someone wish to file for Legal Separation?
*It doesn't require residency (i.e. 6 month) in California and 3 months in County
*It can be convert to Dissolution once residency is established
*You don't have to wait 6 months to file statutorily period from the time the other party is served/files a Response before Judgment of Legal Separation entered.
*It also does not terminate:
*Martial Status
*Social Security
*Health Insurance
